Yet another sheriff says he will not enforce gun initiative

Feb 05, 2019

Grant County Sheriff Tom Jones says he will not enforce a gun control initiative that passed last November until it clears federal court hurdles.

Jones on Monday joined a growing list of Washington sheriffs who oppose Initiative 1639.

Jones says if the initiative eventually is ruled in federal court to be constitutional, he will work with the county prosecutor on the best way to move forward.

Okanogan County Sheriff Tony Hawley sent out a memo to Law Enforcement Personnel Monday, in response to questions and concerns about the initiative.

Hawley said, “This Initiative, as currently written, appears to be unenforceable due to the unclear language and appropriate definitions.”

Hawley said that due to pending legislation to validate/define I-1639 as well as court challenges he is directing personnel to “conduct appropriate investigations and document their findings.” He wrote, “The Okanogan County Sheriff’s Office will continue to investigate all cases thoroughly then document the findings of their investigation.”

Initiative1639 raises the age to purchase a semi-automatic rifle from 18 to 21, calls for enhanced background checks, and requires buyers to complete a firearm safety course, among other provisions.

Republic Police Chief Loren Culp as well as Sheriffs in Adams, Klickitat, Lewis, Stevens, Yakima and other counties have said they will not enforce the initiative due to it’s unconstitutionality.
